Attorney General Ken Cuccinelli Reinforces Rule of Law in Virginia

The Attorney General of Virginia has never been known to back down from a fight to protect the citizens of his state.

After the federal government sued Arizona over SB1070, Delegate Bob Marshall(R-Prince William) requested clarification on Virginia’s own immigration law from AG Ken Cuccinelli.

A few hours ago Cuccinelli released his formal legal opinion that gives police officers and legal authorities the right to check immigration status for those stopped for suspicion of criminal activity or already under arrest.

Virginia law enforcement officers have the same authority to make the same  inquiries as those contemplated by the new Arizona law. So long as the officers have the required level of suspicion to believe that violation of the law has occurred.

A former chief deputy attorney general of Virginia, Claire Gastanaga countered Cuccinelli’s opinion stating:

The Attorney General’s stance largely mirrors the position of advocates’ organizations like the Federation of American Immigration Reform seeking to reduce or prohibit all immigration….The Attorney General has done Virginians a disservice by crafting an ‘activist judge’ opinion that seeks to serve his political agenda rather than objectively interpret the law.

Mr. Cuccinelli does not seek to  “reduce or prohibit all immigration”  only illegal immigration. He is upholding a 2008 law as he was sworn to do when he took office.

Hopefully more state officials will do the same.
