It’s Time For Arizona to Sue the Federal Government

According to Arizona Senator Kyl, Obama told him in a one-on-one meeting, regarding securing the southern border with Mexico, that:
The problem is, . . . if we secure the border, then you all won’t have any reason to support ‘comprehensive immigration reform.’
This administration has not only failed to carry out its constitutional duties to secure the border with Mexico against invasion of illegal aliens includiing members of Mexico’sdrug cartel. As I pointed out in a posting on this blog last April, so- called local “sanctuary” laws should be unconstitutional on their face as they seek to override federal law by shielding illegal aliens. Yet the Obama administration has done nothing about them.
As the Justice Department complaint itself states, federal law imposes criminal penalties on a person who, “conceals, harbors, or shields from detection,” an alien in “knowing or in reckless disregard” of the fact that the alien has unlawfully entered or remained in the United States. 8 U.S.C. § 1324(a)(1)(A)(iii). Yet, as I have pointed out on this blog previously, the Obama administration is doing nothing to enforce the law against the so-called ‘sanctuary cities” that are harboring illegal aliens.
The Obama administration is abusing the Constitution with its faux lawsuit against Arizona and its abdication of federal responsibility to enforce the federal immigration laws now on the books. Hopefully, Arizona will correct this travesty with a well-grounded constitutional challenge of its own.
